Middle Aged Hispanic Woman Knocked Down by Clothing Rack While Waiting To Pay For Items at Well Known Department Store Receives Six-Figure Settlement

N.B., a Dominican native in her 50’s, was shopping with her family at a well-known retailer. As N.B. waited on line to pay the cashier, she was suddenly struck by a clothing rack pushed by a store employee. Though N.B. attempted to move out of the way of the rack, the rack was moving so quickly that her foot was clipped by the wheel of the rack, causing her to fall onto her right side. N.B. suffered a broken hip.
