S.F. was coming home one night with his wife and their four children when he slipped on an ice patch that had formed on his front steps. He realized the icy step was due to a leak in the gutter above the stairs which would create a puddle and freeze on the front steps. The defunct gutter was a complaint both S.F. and his wife had mentioned to their superintendent and maintenance staff more than once in the winters before the accident. That night, S.F.’s fall resulted in three broken bones of his right ankle and he required immediate surgery.
